Recurso de Súplica en contra del Auto del 23 de septiembre de 2011, dictado en el proceso de la referencia por el Magistrado Ponente Nilson Pinilla Pinilla, mediante el cual se decidió rechazar la demanda por haber caducado la acción interpuesta.
La Sala Plena encuentra que el Acto Legislativo 02 de 2004 fue publicado el 28-12-04 y la demanda de inconstitucionalidad presentada por el actor fue el 25-08-11, es decir, mucho después de transcurrido el año previsto para la caducidad de la acción.
Se decide CONFIRMAR en todas sus partes el auto recurrido.
